Depends on jurisdiction. Every US state defines it themselves, and (as pointed out elsewhere) based on vocabulary and spelling, the woman is likely British.
In California, it’s a felony if the person is under 14, and a misdemeanor if they’re between 14 and 18… but if they’re at least 16, and the partner is within two years of their age, there’s no crime (based on age; being under the influence could still make it statutory rape, because you can’t legally consent when you’re out of your gourd). Other states have 16 as the age of consent regardless of the age of the partner; some have it set as 18 no matter what; and I think there are at least a couple where there’s no minimum age as long as the two people are close enough in age (so two 14-year-olds can get it on with no crime being committed, while a 20-year-old who sleeps with a 16-year-old may have broken the law).
